By accessing and using TrailGearList, you accept and agree to be bound by the terms and provision of this agreement.
Permission is granted to temporarily download one copy of the materials (information or software) on TrailGearList's website for personal, non-commercial transitory viewing only.
You are responsible for maintaining the security of your account and password. TrailGearList cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
You retain all rights to any content you submit, post, or display on or through the Service ("User Content"). You are responsible for protecting those rights.
If you choose to publish User Content publicly (for example by creating a public list or public share link), you represent and warrant that you own the User Content or have all necessary rights, licenses, permissions, and consents to publish it. This includes rights to any images you upload, and any third-party content such as logos, product photos, or brand assets.
You also represent and warrant that publishing your public list and associated images does not infringe or violate any third-party rights, including copyright, trademark, privacy, or publicity rights. If your User Content includes images of people, you are responsible for obtaining any permissions required to publish those images.
You retain ownership of your User Content. However, when you publish User Content publicly (for example by creating a public list or public share link), you grant TrailGearList a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for example: resize images, create thumbnails, and generate previews), display, distribute, and otherwise use that public User Content for the purposes of operating, promoting, and improving the Service (including displaying public lists and generating previews for sharing on social platforms).
We may remove or disable access to public User Content that we believe violates these Terms or applicable law. If you believe content on TrailGearList infringes your copyright, please contact us at [email protected] with enough information to identify the work and the allegedly infringing content.
You are solely responsible for your User Content. To the extent permitted by law, you agree to indemnify and hold harmless TrailGearList from claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to User Content you publish publicly, including claims that your User Content infringes third-party rights.
Certain features of the Service require a paid subscription. Subscriptions are billed annually and renew automatically unless you cancel before the renewal date. Prices may change over time; any changes will apply to future subscription periods.
You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, TrailGearList disclaims all warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, TrailGearList will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. TrailGearList's total liability for any claim related to the Service will not exceed the amount you paid to TrailGearList for the Service in the 12 months before the event giving rise to the claim.
These Terms are governed by the laws of the Netherlands, without regard to conflict of laws principles. Any disputes arising out of or relating to these Terms or the Service will be submitted to the competent courts in the Netherlands.
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
If you use TrailGearList, you're agreeing to these terms. That's it.
You can use our website for your own personal use. Don't try to copy or resell anything.
Keep your password safe. If someone hacks your account because you used "password123", that's on you, not us.
Your gear lists and data belong to you. You're responsible for what you create.
If you make a list public, make sure you actually own or have permission to use any images you upload. Don't steal photos from manufacturers or other people's gear lists.
Also, if you include photos of people, make sure they're okay with it being public.
When you make something public, you're letting us display it on our site. We might resize images or create thumbnails to make things load faster. You still own your content, but you're giving us permission to show it.
If someone posts something that breaks the rules or violates copyright, we can take it down. If you see your copyrighted content being used without permission, email us at [email protected] and we'll look into it.
If you post something that gets us sued (like using copyrighted images), you're responsible for covering our legal costs. Don't post stuff you don't have rights to.
Premium features cost money. We charge yearly, and it auto-renews unless you cancel. Prices might go up in the future, but we'll only charge the new price for new subscriptions.
You can cancel anytime. Your subscription will stay active until the end of the period you already paid for, then it stops.
We provide the service as-is. We try our best, but we can't guarantee it'll be perfect, always available, or bug-free. Stuff happens.
If something goes wrong and you want to sue us, the most we'll owe you is what you paid us in the last year. We're not responsible for indirect damages (like lost profits from a trip you couldn't plan because the site was down).
If there's a legal dispute, we'll handle it in the Netherlands under Dutch law. That's where we're based.
If you break the rules, we can kick you off the platform. We'll try to be fair about it, but we reserve the right to ban accounts that violate these terms.
